Order Policies and Procedures: Upon placing an order to buy or sell precious metals with Polar Bear Pours LLC you have entered into a binding and legally enforceable agreement. Availability and pricing are subject to change without notice.

 

Your credit card or debit card information is required to guarantee all orders, in order to reserve and lock in a price. By making a purchase on our site, you expressly authorize Polar Bear Pours LLC to authorize and capture your credit or debit card payment prior to shipment.

Payment Options: Polar Bear Pours LLC requires that all payments be made by PayPal, credit card, debit card, bank wire, personal check, certified check, cashier’s check, or online bill payments in check form. Direct Bank wire is always recommended for orders over $5,000. Polar Bear Pours LLC does not accept cash on delivery orders. Polar Bear Pours LLC reserves the right to cancel orders where payment is not dated within five (5) business days for all check orders and bank wire orders. In order to guarantee the price that you locked in, your payment must be received by Polar Bear Pours LLC within those five business days. In most instances, orders will be denied if payment is completed after the allotted time frame. If we choose to accept your late payment, a $30 late payment fee will be applied. Polar Bear Pours LLC reserves the right to hold and wait for the clearing of all personal checks, certified checks, cashier’s checks, or online bill payments in check form for up to ten (10) business days prior to shipping out items. In the instance of a bounced paper check payment, you will be required to send us a new check with $30 added to the original total to cover the bounced check fee and Polar Bear Pours LLC reserves the right to cancel the order and charge cancellation fees, or bill the payable balance to the credit/debit card on file.

 

Chargeback Policy: You agree not to file a credit card or debit card chargeback regarding any purchase and abide by the dispute resolution procedures listed. In the event that you breach this agreement and file a chargeback, upon a resolution in our favor of the chargeback by either the credit card issuing bank, the credit card processor or by VISA, MASTERCARD, or DISCOVER, you agree to reimburse us for any costs incurred in researching and responding to such chargeback, including without limitation, our actual costs paid to the credit card processor or our banks, other third parties, and the reasonable value of the time of our employees and owners spent on the matter, as determined in our discretion in good faith. You further agree that all dispute resolution procedures below will be deemed waived by you, and that these amounts will be added to the original amount of the order, and that this total amount will then be immediately due and payable. If your chargeback is upheld, you agree to pay all of the same costs, in addition to the original purchase price.

 

Cancellation Policy: Due to the volatile nature of the bullion market, all gold, silver, platinum, and palladium bullion sales are final.  The customer enters into a legally binding agreement once the order is submitted and confirmed, and may not cancel or modify their order afterward. If the customer still insists upon cancellation after the order is placed, the 10% deposit held for check/wire orders WILL be collected. If the customer paid by card or Paypal, a 10% fee will be charged to their source of payment and they will be refunded the other 90%.

 

Documentation: Polar Bear Pours LLC reserves the right to request additional documentation for certain credit card orders or any other orders.  Polar Bear Pours LLC expressly reserves the right to refuse or cancel any order, for any reason, at its sole discretion, regardless of the payment method and price confirmation.

 

Return Policy: At Polar Bear Pours LLC all sales are final. Any returns are at our discretion.

 

Polar Bear Pours LLC does charge 10% of the total purchase price as a restocking fee on all orders that are returned. Also, when returning bullion products, the customer may be required to pay additional market loss penalties on item returns at the discretion of Polar Bear Pours LLC. If market gains were to be incurred on a refund, those gains shall remain the property of Polar Bear Pours LLC

Collections Expense: In the event that Polar Bear Pours LLC has to take any action against a customer in order to enforce your obligations under this User Agreement, including, without limitation, turning your account over to a collection agency or a lawyer for collection, the customer shall have to pay all of the costs and the expenses incurred by Polar Bear Pours LLC including without limitation, reasonable attorney fees, in connection with such actions.

 

Shipping: Polar Bear Pours LLC normally ships with the United States Postal Service (USPS), but may at its discretion choose to use a different shipping provider. Packages may be combined, or partially shipped. Polar Bear Pours LLC reserves the right to ship packages however needed at the time.

 

Polar Bear Pours LLC strives to protect your shipments by being discreet with our shipping labels and do not disclose or give any indication that contents inside the package contain valuable precious metals. When your items are shipped you will receive an email confirmation along with tracking information for your shipment. We do not ship to any forwarding facilities, drop locations, or non-USPS mail services such as UPS stores, Mail Boxes, etc.

 

All PayPal orders require both the billing and shipping addresses to be verified and confirmed.

 

We provide insurance for free on every package. Our insurance will only be covered if the item is lost or damaged in transit. We will not be responsible if the package tracking information shows as delivered. Once the item shows that it was delivered as promised as per our tracking information, we are no longer liable for our insurance policy and it is the customer’s responsibility at that point. When we ship the items to you, if the items are damaged or lost in transit, we will pursue any claims with our insurance policy. If an item is lost in transit we reserve the right at our own discretion to reship your item or provide you with a refund.

 

Please note that Polar Bear Pours LLC will not be responsible for reimbursements or insurance claims on packages that are successfully delivered as addressed. Our liability and insurance cease the moment the package is signed for or left at the specified delivery address. This is standard in the industry, there is no insuring a package that has been scanned as delivered.

 

We currently do not ship internationally. We only ship to the United States.

 

Pricing: All prices quoted on our website are in U.S. Dollars. While we work hard to ensure that all of our inventory and prices are current, discrepancies may occur at times due to product availability and changing market conditions, as well as typographical errors. Most of our products are bullion products which are constantly changing in price. As a result, the final prices of your items will be determined at the time of checkout. We reserve the right to correct pricing errors etc, even after sale is complete.

 

We strive hard to assure the accuracy and information of the products and pricing that we provide on our site. However, pricing or typographical errors may occur at times and in the event that an item is priced improperly due to an error in pricing or information of the product.  Polar Bear Pours LLC shall have the right at its sole discretion to cancel or refuse any orders placed on any item. We will notify you via email of such cancellation and do apologize if situations like this arise.

 

In addition to the other rights and remedies available to Polar Bear Pours LLC, in the event of any failure by you to comply with this User Agreement, Bullion Exchanges reserves the right to charge the credit card which you have provided to Bullion Exchanges including, without limitation, any and all market losses incurred by Bullion Exchanges including cancellation fees for accepting your orders to either buy from or sell to us as a result of price and market fluctuations for which you did not fulfill. You expressly authorize Polar Bear Pours LLC to charge your credit card for all of such amounts, including any fees incurred by chargebacks.

Termination of Use: Polar Bear Pours LLC reserves the right and sole discretion to suspend or terminate access to or part of its website at its discretion without any notice or reason. We do not electronically store credit card information, for security reasons.
